Overview of Indian Design Patent Classification
The Locarno Classification, established by the Locarno Agreement (1968), is an international classification used for the purposes of the registration of industrial designs. In India, the design registration system largely follows the Locarno Classification system for categorizing articles.
Why use the Locarno Classification?
- Standardization: It ensures a unified system for classifying designs globally.
- Searchability: Facilitates design searches to avoid infringement.
- Legal Requirement: Applicants must specify the correct class and subclass in their application (Form-1).
Guidelines for Classification (Form 1)
When filing for a design patent in India using Form 1, accurate classification is crucial. The classification is based on the function of the article. If an article has multiple uses, it should be classified according to its primary purpose.
Expert Insight: Using Search
Use the search bar above to type in the name of your product (e.g., "Bottle") to find the appropriate Class and Sub-class instantly. Incorrect classification can lead to objections during examination.
